Mobile man’s murder conviction overturned


The Alabama Court of Criminal Appeals has reversed the murder conviction of a Mobile man.

Derrick Shawn Penn was on death row after he was found guilty of two capital murder charges in 2011. He’s accused in the shooting deaths of his estranged wife and her boyfriend. Prosecutors say the crime happened at Janet Penn’s home on Eagle Drive in May 2009. They say Penn shot Janet to death then pistol whipped Demetrius Powe to death after the gun jammed.

The conviction was overturned after the appeal court says errors occurred in the trial. Penn can be re-tried on the capital murder charges.
